The Investigation Led To $860000 In Back Wages And Damages Paid To Performance Drywall Workers Plus A Nearly $50000 Fine

A San Diego drywall company is accused of failing to pay hundreds of its workers overtime wages as required by law, according to a U.S. Department of Labor investigation.
Federal investigators found that New Vision Drywall Inc. operating as Performance Drywall denied overtime wages to 568 installers, tapers and hangers, paying them on a piece-rate basis rather than based on the numbers of hours worked, officials said. Some of the employees worked up to 58 hours per week.
The practice violated the Fair Labor Standards Act, which requires employers to pay overtime for hours worked over a 40-hour workweek at a rate of at least 1½ times the regular wage.
The investigation led to the recovery of more than $860,000 in back wages and liquidated damages for the workers. The company, based in the Bay Ho neighborhood, was also fined nearly $50,000.
The investigation, which covered a three-year period from January 2018 to January 2021, was a first for the company, said Labor Department spokesperson Jose Carnevali.
The company did not immediately respond to a request for comment Thursday.
Anonymous comments on the employment services website indeed.com were mixed about the work conditions at Performance, but some mentioned inconsistent pay, long hours and no overtime.
Labor officials said compliance failures continue to be a concern in the San Diego construction industry, even as the real estate market has soared.
